OUTRAGE!!!
Arizona authorities have charged an 8-year-old boy with two counts of pre-meditated murder. This is so outrageous on so many levels, I don't even know where to begin. They interrogated an 8-year-old child (whose father had just been murdered) without an attorney or parent present. He is EIGHT YEARS OLD! Even assuming he did shoot and kill these two people, an 8-year-old child does not have the capacity to commit premeditated murder. Somebody, somewhere, please stop this insanity!
Outrageous, indeed, but it's why we have judges.

ReplyDeleteThere are exceptions to the generality of your assumption about capacity. I was married to someone who planned to murder her infant sister, disguising it as an accident, and got caught in the act seconds before putting the baby out the window for its fall to the concrete below. She was four at the time.
ReplyDeleteIt is tricky, it depends on the child, in these times children are underated more than any other time, even though most of them are exposed to a greater base of knowledge than any other time, some children still live the normal kids life as we know it in the past, but the privilages given by caregivers and the exposure of knowledge an 8 year old may perfectly understand what is murder
ReplyDeleteUnited States justice is one of the biggest scams of all times,the balance on the scales of justice weighs on rhetoric too much and the legal system, totally ignores what is fair or right, what is right is not allways what is written, but that which satisfies itself by logic and reason,he did need to have a lawyer present, it would not be ridiculous if he admitted to premeditated murder and was examined and found to have a clear understanding of what he did, however the united states justice system has a history of being careless, lazy, and unwilling to go this way unless you are covered by the protection of some high powered lawyer
ReplyDeleteThe truth is, we expect judges and juries to be some sort of constant justice machine. Most judges are idiots, and the ones that aren't are corrupt. I only hope that the 8 year old can recover his life somehow. Rehabilitation is the only way to combat crime.
ReplyDeleteAn 8 year old being tried as an adult!?! What is that? How can an 8 year old child understand the consequences of their actions? He might have known it was wrong, but there is no way he could have understood the impact of his crime. Help this child to become a productive member of society, somehow.

ReplyDeleteSee Garrret v Dailey, in which a 5-year old was found liable of having committed premeditated assault and battery on an adult.
I don't see the difference, since by 8 years old, kids can know full-well what it means to kill someone; it's false to say that NO 8-year old is thus capable, simply because of their age; I assure you that I did. The rule of 7's doesn't even apply in all cases, but rather it's just a general guideline.
kids aren't as innocent as you seem to think-- which is why so much bullying happens among kids, i.e. adults think it's "cute."
Kinda like when women molest children and adolescents, and dirty old men think it's "hot" since they harbor similar feelings of denial.
Sounds like someone's in similar denial; just remember that grizzly-bears are cute too.

ReplyDeleteI too have experienced this in a different form. I was incarcerated twice for a crime that was proven I didn't commit. Perjured testimony was proven and still used to convict. Exculpatory evidence was suppressed in 4 video cameras proving my innocence. My attorney did everything in her power to throw the case in which I have never seen my son. Isaiah is 8 now. Every pass code is his name, every sound heard is a new idea. Evereybody including my family seems as if they got paid and dont want to get invollved. Where sis an 8 year old get a gun? Once he got it, where did he learn to shoot well enough to kill 2 people. The problem is not guns, it's the public's exposure to them on TV, games, at the neighbors, etc. An 8 year old child would not have the reasoning power to override the urge to express anger.
